Submission of 2016 Home Mortgage Disclosure Act Data3/1/2017 12:00 AMDeadline
Credit unions located in metropolitan areas that engage in certain types of residential mortgage lending and that had assets exceeding $44 million as of December 31, 2015, must file a report this year on mortgage loan applications received during 2016.  The filing is required under the Home Mortgage Disclosure Act (HMDA), as implemented by the Consumer Financial Protection Bureau’s Regulation C. Enacted during the depths of the Great Depression, the law enabled credit unions to be organized throughout the United States under charters approved by the federal government. A proposed rule approved by the NCUA Board would create a more uniform process for appealing certain program office decisions to the Board. Several existing NCUA regulations provide a right of appeal, but these generally lack uniformity and may be confusing to parties who might seek to appeal an adverse decision to the Board. Appeals of material, examination-related supervisory determinations would benefit from greater due process under a proposed rule approved by the Board. Under the proposed rule, an appeal at any level would not affect, delay, or impede any formal or informal supervisory or enforcement action in progress. Likewise, it would not affect NCUA’s authority to take any supervisory or enforcement action against a federally insured credit union. Grant for Underserved Communities Application Deadline8/31/2017 12:00 AMDeadline
 As part of our 2017 grant round, eligible low-income credit unions can apply for a grant to support projects that reach people living in our nation’s underserved communities. The maximum award is $25,000 dollars. Applications for funding under the outreach to underserved communities initiative must be received no later than Aug. 31 at 3 p.m. Eastern. NCUA is seeking comments on two proposed changes to its regulations covering corporate credit unions with respect to capital calculations. The first change would better align capital components with a corporate credit union’s financial statements. The second would clarify the minimum retained earnings requirement for corporate credit unions. Requirements for Insurance; National Credit Union Share Insurance Fund Equity Distributions9/5/2017 12:00 AMDeadline
Credit unions would avoid a possible Share Insurance Fund premium in 2017 and receive a distribution in 2018 under a proposed plan, approved by the Board, to close the Temporary Corporate Credit Union Share Insurance Fund this year. The proposed plan, described online here, is available for public comment. The NCUA must receive comments no later than Sept. 5.

Emergency Mergers – Chartering and Field of Membership9/29/2017 12:00 AMDeadline
The proposed rule would amend the definition of the phrase “in danger of insolvency” in the agency’s Chartering and Field of Membership Manual, lengthen by six months the time period for two of those categories and add a fourth category, to include credit unions that have been granted or received Section 208 assistance within the 15 months before a determination of a danger of insolvency has been made. Home Mortgage Disclosure Act Data Collection Due3/1/2018 12:00 AMDeadline
Regulation C requires the collection of  HMDA data associated with mortgage loan applications processed during 2017, if:
Your credit union’s total assets as of December 31, 2016, exceeded $44 million;
Your credit union had a home or branch office in a Metropolitan Statistical Area on December 31, 2016;
Your credit union originated at least one home purchase loan (other than temporary financing such as a construction loan) or refinanced a home purchase loan, secured by a first lien on a one-to-four-family dwelling during 2016; and
Your credit union originated at least 25 home purchase loans, including refinancings of home purchase loans in each of the two preceding calendar years (2015 and 2016). If your credit union meets all four criteria, you must collect HMDA data during calendar year 2017 and submit the data to the Consumer Financial Protection Bureau no later than March 1, 2018.  https://www.ncua.gov/regulation-supervision/Pages/policy-compliance/communications/regulatory-alerts/2017/02.aspx

Proposed Involuntary Liquidation of Federal Credit Unions and Claims Procedures Rule4/2/2018 12:00 AMDeadline
The NCUA Board proposes to amend part 709 of its rules to update and clarify the procedures that apply to claims administration for federally insured credit unions that enter involuntary liquidation. Specifically, the proposal would amend the current rule's payout priority provision by specifying the conditions that claims in the nature of severance must meet to be allowed as provable claims.

Federally insured, low-income credit unions interested in becoming certified community development financial institutions may be eligible to use the NCUA’s streamlined application. In the streamlined process low-income credit unions submit data on loan originations to the NCUA’s Office of Credit Union Resources and Expansion. In recognition of the need to support this vital mission, the Federal Financial Institutions Examination Council (FFIEC) is publishing a Cybersecurity Resources Guide for financial institutions. The programs and initiatives included in the guide are designed for, or otherwise available to, financial institutions. These resources are actionable and help financial institutions meet their control objectives regardless of whether they use the FFIEC Cybersecurity Assessment Tool, NIST Cybersecurity Framework, Financial Services Sector Specific Cybersecurity Profile, or any other methodology to assess their cybersecurity preparedness.
